1. About this policy

This Acceptable Use Policy sets out the rules for using www.ivapegreatshop.ie (the "Site"), operated by Clayton Leonard Enterprises Ltd, Unit 19, Seatown Business Campus, Swords, Co. Dublin, K67 Y673, Ireland. It forms part of our Terms & Conditions. By using the Site you agree to this policy.

2. Age restriction

The Site is intended only for persons aged 18 or over. You must not use the Site if you are under 18, and you must not use the Site to obtain or attempt to obtain nicotine inhaling products for any person under 18. Doing so may be a criminal offence under the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023.

3. Prohibited uses

You must not use the Site:

  • in any way that breaches applicable Irish, EU or other law or regulation;
  • to provide false information, including a false name, address or date of birth, or to circumvent or attempt to circumvent our age-verification measures;
  • to purchase products for unauthorised resale, or for supply to any person under 18;
  • fraudulently, including using payment details without authorisation or abusing promotions, discount codes or refunds;
  • to transmit any viruses, malware or other harmful code, or to attempt to gain unauthorised access to the Site, its servers or any connected database;
  • to scrape, harvest or copy Site content or data by automated means without our written permission;
  • to interfere with the proper working of the Site, including by overloading or disrupting it;
  • to impersonate us, our staff or any other person.

4. User content and reviews

Where the Site allows you to post reviews or other content, your contributions must be honest, based on your own experience, lawful, and must not be defamatory, obscene, threatening or infringe any third party's rights. You must not post content that promotes the use of nicotine products by minors, or that makes health or smoking-cessation claims about products. We may remove any content that breaches this policy and we may use reviews in accordance with our Privacy Policy.

5. Breach of this policy

If you breach this policy we may, depending on the seriousness of the breach: issue a warning; remove content; suspend or close your account; cancel orders; block your access to the Site; and/or report the matter to An Garda Síochána or other relevant authorities, and cooperate with them by disclosing your identity where legally appropriate. We may also seek reimbursement of any losses caused by your breach.

6. Changes

We may amend this policy at any time by publishing an updated version on this page. Please check it periodically, as you are bound by the version in force when you use the Site.

7. Governing law

This policy is governed by the laws of Ireland, and the courts of Ireland have jurisdiction over any dispute arising from it, subject to any mandatory consumer protections applying in your country of residence within the EU.
