1. Who we are

This website, www.ivapegreatshop.ie (the "Site"), is operated by Clayton Leonard Enterprises Ltd (referred to as "we", "us" or "our"), a company registered in Ireland.

These Terms & Conditions (the "Terms") apply to your use of the Site and to every order you place with us. Please read them before ordering. By using the Site or placing an order, you agree to these Terms. Nothing in these Terms affects your statutory rights as a consumer under Irish and EU law.

2. Age restriction — strictly 18+

The products sold on this Site are nicotine inhaling products and related items which may not be sold to any person under 18 years of age. It is an offence under the Public Health (Tobacco Products and Nicotine Inhaling Products) Act 2023 to sell nicotine inhaling products to a person under 18.

  • You may only use this Site and place orders if you are 18 years of age or older.
  • We do not sell to persons under 18 in any circumstances. Parental or guardian permission does not make a person under 18 eligible to buy from, register with, or use this Site.
  • By placing an order you confirm that you are at least 18 and that the products are for your own use and will not be supplied to any person under 18.
  • We operate age verification at or before the point of sale and/or delivery. We may request proof of age at any time and we will cancel and refund any order where we cannot satisfactorily verify that the customer is 18 or over.

3. Your account

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. You must provide accurate and current information, including your date of birth. We may suspend or close an account where we reasonably believe the account holder is under 18, information provided is false, or these Terms have been breached.

4. Products and regulatory compliance

All nicotine-containing products sold on this Site are notified to the competent authorities via the EU Common Entry Gate (EU-CEG) and comply with Directive 2014/40/EU (the Tobacco Products Directive) as implemented in Ireland by the European Union (Manufacture, Presentation and Sale of Tobacco and Related Products) Regulations 2016 (S.I. Product images are for illustration. We may withdraw or amend products where required by law, including in connection with the Public Health (Single-Use Vapes) Act 2026.

5. Orders and contract formation

Your order is an offer to buy. After you place an order you will receive an order acknowledgement; this is not acceptance. A contract is formed when we dispatch the goods and send you a dispatch confirmation. We may decline or cancel any order before dispatch, including where: age verification fails; a product is unavailable; there is an obvious pricing or description error; or we reasonably suspect the purchase is for a person under 18 or for unauthorised resale. If we cancel an order that you have paid for, we will refund you in full without undue delay.

6. Prices and payment

All prices are shown in euro (€) and include VAT at the applicable Irish rate. Delivery charges, if any, are shown before you confirm your order. The price payable is the price displayed on the product page at the time you place your order. If a pricing error is obvious and could reasonably have been recognised as an error, we are not obliged to supply at the incorrect price. Payment is taken at checkout through our third-party payment providers; we do not store your full card details.

7. Delivery

We currently deliver within the Republic of Ireland only. Delivery timeframes, charges and the free-delivery threshold are set out in our Delivery & Returns Policy, which forms part of these Terms.

8. Right to cancel (cooling-off) and returns

As a consumer buying at a distance, you have the right under the Consumer Rights Act 2022 to cancel your order within 14 days of the day you (or a person you nominate) receive the goods, without giving a reason, and a further 14 days from cancellation to return the goods. This right does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed — this includes e-liquids, pods, cartridges, coils and drip tips whose packaging or seals have been opened. 9. Faulty goods — your statutory rights

Under the Consumer Rights Act 2022, goods we supply must be of merchantable quality, fit for purpose and as described. If a product is faulty, you are entitled to a remedy — repair, replacement, price reduction or refund — as provided by law, at no cost to you. Nothing in these Terms limits or excludes those rights. 10. Acceptable use of the Site

Your use of the Site is also subject to our Acceptable Use Policy. You must not use the Site for any unlawful purpose, including purchasing products on behalf of a person under 18.

11. Intellectual property

All content on the Site — including text, images, logos, product descriptions and design — is owned by or licensed to us and is protected by copyright, trade mark and other intellectual property laws. You may not reproduce or commercially exploit any Site content without our prior written consent.

12. Privacy

We process personal data in accordance with our Privacy Policy and Cookie Policy.

13. Our liability

  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under Irish law, including your statutory rights as a consumer.
  • Subject to the above, our total liability to you in connection with any order is limited to the greater of (a) €5,000 or (b) the total amount you paid us in the six (6) months before the event giving rise to the claim.
  • We are not liable for losses that were not reasonably foreseeable to both parties when the contract was made, or for losses relating to any business of yours.

14. Health information

Products sold on this Site contain nicotine, which is an addictive substance. These products are intended for existing adult smokers and vapers. They are not smoking-cessation medicines and we make no medicinal or health claims for them. If you have concerns about your health or about quitting smoking, consult your pharmacist, GP or the HSE QUIT service.

15. Complaints and disputes

If you have a complaint, please contact us first via our Contact Us page — we aim to resolve issues quickly. If you are not satisfied, you may contact the Competition and Consumer Protection Commission (CCPC) (www.ccpc.ie) for information on your consumer rights. Consumers may also be able to use the small claims procedure of the Irish District Court for claims up to the applicable limit.

16. General

  • If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force.
  • A failure by us to enforce any provision is not a waiver of it.
  • These Terms are personal to you; a person who is not a party to the contract has no right to enforce any of its terms.
  • We may update these Terms from time to time. The version in force when you place your order applies to that order.

17. Governing law and jurisdiction

These Terms, and any contract between us, are governed by the laws of Ireland. Any dispute may be brought before the courts of Ireland. If you are a consumer resident in another EU member state, nothing in this clause deprives you of the protection of mandatory provisions of the law of your country of residence or of your right to bring or defend proceedings there.
